Statement of Policy and Purpose
CyberHouse Corporation has strict anti-SPAM policies and will not hesitate to use whatever legal avenues are available to enforce these policies. "SPAM", or "SPAMming," is herein defined as the broadcasting of mass quantities of unsolicited E-mail which are usually, but not necessarily, sent for commercial purposes. Because of recent increases in the practice of SPAMming on the Internet by unscrupulous individuals and organizations, the resources of many Internet and Web related service providers have been strained to the point where interruption and loss of business and/or business services have resulted. We consider the most egregious offenses of spamming to be those involving the unauthorized use of third party E-mail sending and/or relaying resources.
 
Authorized Use
CyberHouse Employees, Clients, or Client's authorized users will be afforded the privilege of unlimited relaying of E-mail messages free of E-mail relaying charges as long as such use does not constitute SPAMming.
 
Unauthorized Use
Any Entity that is not an authorized user as defined above, and that accesses any CyberHouse network resources will be billed for the use of those resources based on our published Non-subscriber Usage Rates. SPAMming, whether originating on our network or relayed from a remote source, is never authorized and such use may be in violation of Federal Law and/or the laws of individual states. We will bill for such activities and/or pursue civil and criminal actions in courts of competent jurisdiction.
 
Abuse by Authorized Users
As a CyberHouse client you agree to be bound by the terms and conditions of usage of our network resources. Violation of the terms and conditions in force at any particular time are grounds for immediate termination of account privileges. Further, activities such as SPAMming may incur additional charges which you agree to pay. These charges are above and beyond the normal subscription fees.
 
Abuse by Unauthorized Users
Only CyberHouse Employees, Clients, or Client's authorized users are allowed the use of our resources for the purposes of sending and/or relaying E-mail messages. Any other entity is strictly forbidden this privilege. In the event that an unauthorized user illegally accesses our network resources for the purpose of sending and/or relaying E-mail messages without our prior written consent, CyberHouse will invoice that entity for E-mail Relaying Fees. Anyone using CyberHouse network resources, whether or not with prior authorization, implicitly agrees to these terms and conditions.
 
Email Relaying Fees
If you are an unauthorized user of CyberHouse's E-mail relaying resources, your use of our relaying resources will constitute an agreement to pay CyberHouse E-mail Relaying Fees for those services used. E-mail messages accepted for delivery will constitute services rendered and will be invoiced at the rate of 0.25 USD per E-mail message addressee, whether or not actually delivered.
 
Other Fees
If, as a result of your unauthorized use of our E-mail relaying resources, our E-mail SMTP and/or POP3 server become overloaded or are otherwise rendered inoperable or nonserviceable, you will be invoiced at the rate of $500 per hour for any such time that these services are unavailable to our clients, plus $85 per man-hour for data recovery and incident mitigation. Failure to pay these E-mail Relaying fees within 30 days from our invoicing will result in legal action for the purposes of collecting these fees plus any damages suffered by CyberHouse because of any loss of business and/or business services associated with your use of our E-mail sending and/or relaying services. You also agree that you will pay all court costs and reasonable attorney's fees arising from any action brought against you by CyberHouse in an effort to enforce its rights under the terms of this agreement, without respect to the prevailing party. Additionally, anonymous users agree to pay all costs incurred by CyberHouse related to identifying and invoicing such users.
